appeal
Please have your Enforcement Notice, and full details of your appeal, including supporting evidence ready before submitting an appeal.
NZES make every attempt to ensure that when we issue an Enforcement Notice, that we have taken the necessary steps to ensure that when we issue an Enforcement Notice it is both correct and binding. This includes photographic and or video evidence of the specified vehicles.
However there may be instances where there may be additional information unknown to NZES, which can impact the issue of an Enforcement Notice.
Reasons to lodge an appeal
Some of the possible reasons for a valid appeal may include:
Incorrect information on the Enforcement Notice:
This may include incorrect location, or incorrect vehicle details. If you can provide evidence that the information on the ticket is incorrect, NZES will consider this information, and may rescind the Enforcement Notice.
Extenuating circumstances
There may be instances where NZES was unaware of certain circumstanece where the property owner may have given permission to use a carpark, without notifying NZES.
Inadequate signage
If you believe our signs are not present at a carpark, please provide us with photographic evidence to support your appeal. Please note, that NZES cannot be held responsible for vehicle owners failing to notice, and or read signs detailing the “terms and conditions” of parking.
What isn’t a valid reason for an appeal?
I didn’t see the signs – unfortunately this is not a valid reason for an appeal. We are responsible for ensuring carparks managed by NZES have the appropriate signage according to New Zealand law. We cannot be held responsible for vehicle owners failing to read, or ignoring the terms and conditions on the signs.
Your fees are not acceptable – NZES are able to provide substantial evidence as to the breakdown of our fees, and the associated costs of issuing an Enforcement Notice. We believe our fees represent a fair and equitable amount. Our fees are constantly reviewed against industry best practice, and represent a fair and reasonable cost of doing business in New Zealand.
I was only in the carpark for a small period – Please consider that the parking activity that generated the Enforcement Notice also has a flow on effect for the business owner of the carpark you chose to occupy without permission. This can mean New Zealand business lose both customers, and revenue as a result of your actions. NZES will not entertain any discussions around self entitlement of individuals.
